This Privacy Policy serves to inform you of Xcalibur’s policies and procedures for 

  1. The collection, use and disclosure of the data required for evaluation, research and reporting of education related data.  
  2. The collection, use, and disclosure of the information Xcalibur receives when you access and use our web applications and sites.
  3. The collection, use, and disclosure of information Xcalibur receives from other services provided from time to time such as webinars and conferences.

Xcalibur, Inc. is committed to keeping all personal information collected confidential, secure, and private.  Our Privacy Policy was designed and created to ensure those affiliated with Xcalibur, Inc. of our commitment and realization of our obligation not only to meet but exceed most existing privacy standards.

By using Xcalibur services, you hereby warrant and represent that (i) you have read, understand, and agree to this Privacy Policy, and (ii) if you are acting on behalf of your employer or an entity, you have the authority to accept and agree to this Privacy Policy.

This Privacy Policy may be updated from time to time.  Xcalibur will notify you of any material changes by posting the new Privacy Policy on our website.  Your use of the services following any notice will signify and constitute your agreement to and acceptance of such revised Privacy Policy.

Microsoft Azure

Xcalibur applications are hosted on Microsoft Azure and are subject to their privacy policy which may or may not be as protective as this Privacy Policy.  By using Xcalibur applications hosted by Microsoft Azure, you are agreeing to be bound by Microsoft Azure’s privacy policy, which can be found at https://privacy.microsoft.com/en-us/PrivacyStatement.

Information Collected for Evaluation, Research, and Reporting of Education Related Data.

For the duration of formally contracted evaluation, research, and reporting services between Xcalibur and various educational institutions, agencies, and grants, Xcalibur staff will have access to confidential information related to participants of the educational programs.  Access to this information is vital for Xcalibur to provide services as specified by our contracts.

This information could include personally Identifying Information (PII).  PII is categorized as either non-sensitive PII or sensitive PII.  Non-sensitive PII makes it possible to identify, contact, or locate a single person.  For example, names, addresses, phone numbers, email addresses constitute non-sensitive  PII.  The sensitive PII is currently defined by the Federal Communications Commission (FCC) as credit card numbers, financial account numbers, government issued ID numbers, health information, or information regarding children.

All student related PII data are treated as sensitive, and all Xcalibur Staff adhere to the Family Educational Rights and Privacy Act (FERPA) when managing, analyzing, and reporting this data.  

Xcalibur staff will maintain the confidentiality of the individual data records at all times.  All discussions, deliberations, records, and information generated or maintained regarding this data will not be disclosed to any unauthorized person.

Xcalibur agrees to not divulge any information or records concerning any student or program participant without proper authorization in accordance with the state and federal law and interagency agreements.  Xcalibur recognizes that any discussion of, or release of, PII data related to any current or former students or program participants maintained by Xcalibur to any unauthorized person is forbidden and may be grounds for legal action.

Other Information Collected

When you interact with us, we may collect Personal Information that you voluntarily provide.  For example, when you sign up for an Xcalibur Conference or Webinar.   We may ask for information such as your name, email address, phone number.  In addition, we may collect information from you when you communicate with us via email.  You may choose not to provide any information that is requested by us, but this may limit your ability to use the Services.

We and/or our third-party service providers may also collect information in a form that does not personally identify you (Non-Personal Information).  Non-personal information can include personal information that has been de-identified.  De-identified information is information that has been rendered anonymous.  We and/or third-party service providers may obtain non-personal information about you from information that you provide, either separately or together with your personal information.

It is possible that we may gather information about your computer hardware and/or software.  Such collected information may include, but not limited to your IP address, browser type, domain name, and access time.  The gathering of this information may be used for maintaining the quality of service we provide, as well as providing overall general statistics related to the use of our websites, applications, and services.

Cookies and Other Technologies Used

Xcalibur and/or out third-party service providers may use cookies (both session cookies and persistent cookies) or other online technologies to analyze trends, administer our website/applications, track your movements around our Site, better understand how you interact with our website/applications, determine interest in particular content and monitor aggregate usage by visitors and online traffic routing. We may generate or receive reports based on the use of these technologies on an individual and aggregated basis. You may be able to instruct your browser, by changing its option, to stop accepting cookies or to prompt you before accepting a cookie from the online services you visit. You may also remove persistent cookies by following your web browser’s help file directions. If you do not accept cookies, however, you may not be able to use all portions of our website/applications or all functionality of our website/applications.  Some Xcalibur applications require the use of cookies.

Use of Information Collected

Xcalibur may use your Information, either alone or in combination with other information, so that we can provide, enhance and personalize our services and related content.

 Your Information is used and disclosed for, but is not limited to, the following purposes:

  • to provide you with the best user experience possible;
  • to respond to your questions and comments;
  • to communicate with you regarding updates to our services;
  • to send you newsletters or other subscriptions;
  • to help us develop, customize, deliver, support and improve our services and content;
  • to protect the rights or property of Xcalibur or our users, and prevent fraud and other prohibited or illegal activities;

  • to monitor and analyze use of the services and for the technical administration of the services.

Xcalibur may combine your Personal Information with Non-Personal Information and aggregate it with information collected from other users or sources to attempt to provide you with a better experience, to improve the quality of our services, and to analyze and understand how our services are used. Xcalibur may also use the combined information without aggregating it to serve you specifically. After you terminate your use of the Services, Xcalibur may continue to use your Non-Personal Information for statistical purposes or other purposes as we see fit. Please note that Xcalibur cannot guarantee that Non-Personal Information will not identify you as we cannot guarantee that others with access to Non-Personal Information may not have knowledge sufficient to identify you.

Xcalibur will not sell, rent or lease any of your personal information to others.
